Mr Aloy Ejimakor,The Special Counsel to the Leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu, has spoken that the only option for Nigeria and Kenya regarding the illegal detention of the IPOB Leader is to free him at once.

Kanu’s lawyer who took to his X (formerly Twitter) handle on Tuesday, said that both Nigeria and Kenya violated their own laws and international treaties they were parties to concerning the repatriation of an accused to face prosecution in his own country.

He argued that non of the procedures for repatriation as provided for in the law, was followed in the case of Kanu who was “abducted in Kenya and renditioned” to Nigeria since June 2021.

“Nigerian & Kenyan laws, plus treaties Nigeria ratified provide steps that MUST be taken in returning an accused to face trial in another country. Failure to take such steps, like in the case of #MNK, PERMANENTLY robs the Court of jurisdiction. The only option is to #FreeMNK.”

NewsEmbassy had reported that the Appeal Court sitting in Abuja, had ordered the immediate and unconditional release of Kanu, and his return to Kenya where he was abducted, or Britain country of abode.

Discharging Kanu of all 15 count on treason preferred against him, the court faulted the manner in which the IPOB Leader was renditioned to Nigeria, declaring that it violated all known international protocols on repatriation.

It further recommended compensation to Kanu for the abuse and gross violation of his fundamental human rights.

Similarly, an Abia High Court sitting in Umuahia, had indicated the Federal Government over the September 17 military raid of Kanu’s ancestral compound in Afaraukwu Umuahia.

The court had also recommended that the Federal Government and the security agencies that were involved in the raid should apologize to Kanu for the illegal trauma the action caused him.

Kenya

Despite the judgments of the Court, the Federal Government has refused to free the IPOB Leader as he has since then, remained incarcerated in a solitary confinement at the Abuja headquarters of the Department of the State Security, DSS.

The United Kingdom Opinion on Humans Rights, had also, last year, given Nigeria six months to unconditionally free Kanu. It further recommended punishment for all officials of Government involved in his ordeals.

Meanwhile the Supreme Court has fixed December 15 for the determination of the appeal against the judgment of the Appeal Court regarding Kanu.
